Performance Health Technology (PH Tech) Data Breach Lawsuit

What Happened at PH Tech?
On June 2, 2023, PH Tech was alerted of the security issue involving Progress Software’s MOVEit file transfer too. The MOVEit platform is used by companies like Performance Health Technology to send electronic files securely. When the company learned about the data security incident, they moved their system offline and hired a cybersecurity firm to investigate.
The investigation concluded that an unauthorized person accessed the MOVEit servers and removed PH Tech data files. Personal information and protected health information was accessed and may include the following: name, date of birth, social security number (SSN), address, member ID number, plan ID number, email address, authorization information, diagnosis code, procedure code, and claim information.
“We found out that an unauthorized person used the Progress MOVEit’s software and that PH Tech data files were downloaded,” the organization said in a notice on its website.

PH provides multiple services, including claims processing, data management, care management, utilization management, population management. They support provider sponsored health plans with control over benefits, contracts with providers, medical decisions, care management and population health.
PH Tech did not initially confirm how many individuals were affected by the breach, but a separate notice from the Oregon Health Authority states that an estimated 1.7 million of its members were impacted.

Plaintiffs have alleged that PH Tech failed to encrypt sensitive data, comply with industry data-security standards, dispose of data that was no longer needed, and failed to properly monitor its network to detect vulnerabilities and prevent attacks.
