Tire Defects

Ohio Product Liability Lawyer

Defective Tire Lawyer

Automotive tires have tread, which refers to the rubber part that touches the roadway and consists of grooves and notches.  The depth or width of the tread notches affects the traction the tire has with the road.  Over time, the tread begins to diminish, effectively decreasing the amount of air between the entire tire and the road. As this happens, drivers will sometimes notice a loss of control as in a pulling sensation.   Product liability lawsuits arise when tire defects cause a tread separation leading to a complete loss of control of the vehicle and a vehicle accident and catastrophic injuries.

Who is the Proper Defendant in a Tire Defect Case ?

Tires are generally not made by the manufacturer of the car or truck, and they are often replaced over the course of a car’s life; Therefore, fault may lie on the both the manufacturer of the tire and at times the mechanical shop that installed the tires.  It is important to consider all parties that played a role in placing the tire on the car or truck and any party that inspected the tire prior to the accident.

Types of Tire Defect Flaws

  • Tread on a tire does not last nearly as long as it should, consequently resulting in the driver losing control of his or her vehicle when he does not expect it.
  • Incorrect placement of the belts and overlying tread for the tires, causing tread loss to occur more quickly.
  • Failure of the metal tire frame to stick to the rubber is the leading cause of belt separation, thus leading to lower tread.
  • Cross camber, cross caster, and thrust angle settings misalignment.
  • Inadequate tire thickness.

Types of Injuries Caused by Tire Defects

  • Spinal Cord Injuries
  • Traumatic Brain Injury
  • Wrongful Death

Legal Options

Product Liability: Defective product litigation path is  expensive and complex. The attorney will need to prove the case through expert testimony.  Product liability cases can be some of the most expensive types of litigation, but the cases should be evaluated carefully to determine if a tire defect caused the catastrophic injury.

DO NOT

  • Allow the tires or pieces of the tire be destroyed.  This evidence must be preserved.
  • Allow the car, and any other vehicle if possible, to be destroyed. This evidence must be preserved.
  • Remove any social media postings.
  • Make any statements to insurance companies or automotive company private investigators without first speaking with a qualified attorney.

Recent Tire Recalls

Yokohama Tire Corporation (Yokohama) is recalling certain AVID Touring S tires, size 215/65R16 98T SL, produced between February 2009 and April 2009. The tires may have been produced with an irregular geometry in the casing turn up area above the tire bead in the lower sidewall.

This irregular geometry may lead to a lower sidewall crack resulting in a rapid loss of tire inflation. Rapid air loss while the vehicle is in use may result in a tire failure that could cause a crash.

Yokohama will notify owners, and dealers will replace the tires free of charge. The safety recall is expected to begin on, or about, October 20, 2012. Owners may contact Yokohama at 1-800-423-4544. For more information for this particular recall, please click here.

After two hip replacement surgeries, I was informed that one of the prosthesis was the DuPuy Joint and the other was very similar but manufactured by a different company. After several attempts to contact the manufacturer directly to discuss the claim, I was met with bureaucratic red tape that appeared to be insurmountable. I then turned to Joe Lyon of the Lyon Law Firm who immediately cut through the pro I highly recommend Joe if you are faced with the need for this type of litigation.Tim Ross
I met Joe during what was easily one of the worst times of my life. My husband had been in a serious accident and was a quadriplegic following that accident and remained in one medical facility after another until his death nearly four years later. We had contacted an area attorney who told us we absolutely did not have a case. Then we called a Cleveland firm that took the case and brought in Joe. Joe did so much of the work and became just like family to us. I would highly recommend Joe to anyone and be willing to guarantee that he will do anything and everything possible to get satisfactory results. He is extremely dedicated to his clients and very hard working. Mike and I came to think of him like a son, I still do; if it wasn’t for him I don’t believe our case would have been settled the way it was and may have ended up in a courtroom where the results can go any way.Donna Urchak
