The couple, now in their seventies, used Monsanto’s Roundup regularly for about 30 years for typical landscaping. The class of Roundup lawsuits are based on a conclusion by the World Health Organization’s cancer arm, which classifies glyphosate as “probably carcinogenic.”

In three lawsuits that have gone in favor of cancer victims, the jury was presented with internal company documents that showed Monsanto had no interest in finding out whether Roundup was safe, choosing instead to sell products regardless of health implications. The legal problems are just beginning for Bayer, with more than 13,400 others plaintiffs waiting for a trial or a settlement of their own. Roundup is the most popular weed killer in the world and more cancer claims are likely to follow. Bayer is still defending its position, protecting itself financially, though the only likely way the company could stay afloat may be to settle existing cancer claims. Even though the $2 billion verdict will certainly be reduced by the court, as the U.S. Supreme Court limits the ratio of punitive to compensatory damages, the damages are still very large.

This the third consecutive jury verdict against Bayer’s Roundup cancer exposure, perhaps a harbinger of the other thousands of cases pending. The next glyphosate cancer trial is scheduled for August in Missouri.

Bayer says studies show glyphosate and Roundup are safe for human use. Plaintiffs also note that a proper warning has been missing on the Roundup label for years.
