The Lyon Firm Files Class Action American Financial Resources Complaint
The Lyon Firm has filed a class action data breach lawsuits against American Financial Resources (AFR). Plaintiffs bring this class action against AFR to seek damages for customers as well as current or former employees of AFR who have had their personal information compromised.
The lawsuit alleges that American Financial Resources failed to properly secure and safeguard personal identifiable information, including names, Social Security numbers, driver’s license or account numbers.
AFR is a mortgage lending company that provides real estate lending services to thousands of mortgage brokers, bankers, lenders, homeowners, home buyers, realtors, and contractors nationwide.
On March 9, 2022, AFR notified state Attorneys General and customers about a data breach involving the personal information of thousands of individuals, including customers and current or former employees. The full extent of the types of information, the scope of the breach, and the root cause of the Data Breach has not been disclosed.
The plaintiffs allege that AFR breached their duties, promises, and obligations, and increased the risk that sensitive personal information would be compromised in the event of a cyberattack. Lawyers are citing negligence as a cause of the breach, including a failure to design,
implement, and maintain reasonable data security systems and safeguards, as well as a failure to exercise reasonable care in the hiring, supervision, and training of its employees with industry-standard data security practices.
