INTRODUCTION AND FOUNDING
Following many successes with the national pioneer of Mass Tort Litigation, Lopez Hodes, in the fall of 2006, Joseph M. Lyon started The Lyon Firm. The Firm has a dynamic and growing practice. In the past four years, he and his co-counsels have recovered in excess of 10 million dollars on behalf of their clients. The cases included medical malpractice, pharmaceutical defects, medical device defects, automotive defects, and general personal injury matters. Mr. Lyon has a dynamic and innovative practice and he represents clients locally, throughout the State and on a national level.
A UNIQUE BUSINESS MODEL FOR CLIENT BENEFIT
The business model provides for client interaction with Mr. Lyon throughout the case. Despite the large volume of cases, Mr. Lyon maintains a direct relationship with each client. In order to accomplish this goal, he incorporates the many national relationships that Mr. Lyon has with some of the nation’s top law firms. Given the complexity of the law today and the wide scope of tort liability, it is very common for multiple firms to be working on the same case. By entering joint ventures and sharing the burden of costs, the client is awarded additional expertise, efficiency, attorney contact, and better results at no extra cost.
All cases are performed on a contingency fee, unless the client prefers an hourly rate. This means that unless the case is successful, there are no attorney fees or costs to the client. In all cases, there are associated litigation costs that the Attorney will typically advance, unless the client assumes that responsibility at the outset of the case. The costs will be reimbursed if the case is successful. If the case is not successful, the costs are not required to be reimbursed. The fee is a set percentage and ranges from 33.33% to 40% depending on the complexity of the case and anticipated time frame for resolution. If additional Firms are involved, the percentage remains the same, and the attorney split the fee based upon contribution of value to the development of the case.
POSITIVE CHANGES THROUGH LITIGATION
Joseph Lyon is committed to the local and national community and has witnessed positive changes resulting from its prior and current cases. He takes tremendous pride in the ability to represent individuals, working for them, to create a safer and more secure health care system and safer products for the future. For example, dangerous drugs such as Vioxx and Trasylol have been removed from the market. Toyota has agreed to change parts of its manufacturing process to ensure better quality in its vehicles. Lap Belts are no longer allowed to be placed into center seats. Landlords are abating lead in housing projects. Medical standards of care are improving across the board.
